Terms of Service

These terms are an agreement between you and Mega Fury Services ("we", "us"), the provider of MEGA FURY SERVICES TMS (the "Service"), a transportation management software subscription for freight brokers, carriers and dispatch services. By creating an account or continuing to use the Service, you agree to these terms. If you use the Service for a company, you confirm you have authority to bind that company.

Your account

Keep your login details confidential and your information accurate. You are responsible for activity under your company's accounts.

Acceptable use

• No unlawful use, fraud, spam, or misrepresentation of loads, carriers or payments.
• No infringing anyone's intellectual property.
• No malware, probing, scraping, reverse engineering, or attempts to bypass security or plan limits.
• No reselling or redistributing the Service without written permission.

Licence and ownership

We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. Mega Fury Services retains all rights to the Service, its software, documentation and branding. You keep ownership of your data and grant us a limited licence to host and process it only to provide the Service.

Payments and subscriptions

Payments are processed securely by Stripe on behalf of Mega Fury Services. Billing, renewal, tax, cancellation and refund terms are described here and in our Refund Policy. Subscriptions renew automatically each billing period until cancelled.

Service level

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Mileage, HOS, rate and location data from third parties may be incomplete or delayed and must be verified before relying on it. The Service is provided "as is" to the fullest extent permitted by law.

Liability

To the extent permitted by law, we are not liable for indirect or consequential losses (such as lost profits or data), and our total liability is limited to fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

Suspension and termination

We may suspend or end access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms. After termination you may request an export of your data within 30 days, after which it may be deleted.
